Terms of Service

These Terms of Service ("Terms") govern your use of the EAS LLM Gateway (the "Service"), operated by Elite AI Holdings LLC, 2010 El Camino Real #2000, Santa Clara, CA 95050, USA ("we", "us", "our"). By creating an account, issuing an API key or sending a request to the Service, you agree to these Terms.

What the Service is

The Service is an OpenAI-compatible HTTP API. Requests you send to /v1/chat/completions, /v1/embeddings and /v1/models are forwarded to third-party model providers (currently OpenAI, Anthropic, Groq, Google Gemini and Cloudflare Workers AI) and their responses are returned to you. When a provider is unavailable, your request may be served by an equivalent model from another provider in a published fallback chain; the model that actually answered is named in the response.

Model output is generated by AI and can be wrong. Verify anything important before relying on it. The Service is not legal, financial, medical or other professional advice.

Accounts and API keys

You sign in with an email address; we send a single-use link rather than storing a password. API keys are shown once at creation and stored only as a SHA-256 hash, so a lost key cannot be recovered - rotate it instead. You are responsible for every request made with your keys. Revoke a key in the console immediately if it may have been exposed.

Plans, limits and fair use

Each plan carries a monthly token allowance, a per-minute request limit and a set of models. These limits are enforced in software: exceeding the request rate returns HTTP 429, exceeding the monthly token allowance returns HTTP 402, and requesting a model outside your plan returns HTTP 403. Published limits may change with 30 days' notice for existing subscribers.

Acceptable use

• Do not use the Service to break the law, infringe anyone's rights, or generate content intended to deceive or harm.
• Do not attempt to access another customer's data, keys or usage.
• Do not resell raw access in a way that circumvents your plan's limits, and do not share a key across organisations.
• You must also comply with the acceptable-use policies of the upstream providers that serve your requests.

We may suspend an account that is attacking the Service, running up costs fraudulently, or violating the above. Where the situation allows it we will contact you first.

Your content

You keep ownership of the prompts you send and the output you receive. You grant us only the rights needed to operate the Service: to transmit your request to the provider that serves it and to return the response. See the Privacy Policy for what we retain.

Billing

Paid plans are billed monthly or yearly in advance through Stripe and renew automatically until cancelled. Refunds are covered by the Refund Policy. Prices are shown in US dollars and exclude any taxes that apply where you are.

Availability and liability

The Service is provided "as is", without warranty of any kind. We do not guarantee any level of uptime or that a specific upstream model will remain available. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses.

Termination

You may stop using the Service and cancel a subscription at any time; access continues to the end of the paid period. We may terminate an account for a material breach of these Terms, or with 30 days' notice for any other reason, refunding any unused prepaid period.

Changes and contact

We will post material changes to these Terms on this page and update the date above; continued use after a change means you accept it. These Terms are governed by the laws of the State of California, USA. Questions: support@eliteaiempire.com.
